Terms & conditions

Jacques Monneraud makes ceramic objects by hand in his workshop (hereinafter the “Products”) which he markets on his website www.jacquesmonneraud.com (hereinafter the “Website”).

These terms and conditions of sale (T&Cs) govern the online sale of Products offered by Jacques Monneraud to its customers (hereinafter the “Customer”) via the Website. Jacques Monneraud reserves the right to modify these conditions. The applicable Terms and Conditions are those in force on the date of payment of the order. The Customer declares to have read all of these Terms and Conditions and to accept them without reservation. It is understood that any order placed on the Website entails acceptance of all of these Terms and Conditions. Only persons legally capable of entering into contracts concerning the Products may place orders on the Website.

Jacques Monneraud presents the Products as well as their essential characteristics, and in particular their respective prices, on the Website. The photographs, illustrations and descriptions of the Products are as faithful as possible but cannot ensure an exact similarity with the Product offered for sale. Each Product being the subject of artisanal manufacturing, variations may exist from one example to another within the same series.

The prices of the Products are indicated in Euros, excluding delivery costs. Delivery costs will be specified to the Customer when confirming their order and vary depending on the destination of the order, the weight, as well as the volume of the Product ordered. Delivery costs are established according to the current rates of the post office and carriers. For all Products shipped outside the European Union, customs duties or all local taxes are the exclusive responsibility of the Customer. Jacques Monneraud reserves the right to modify its prices at any time. However, this modification cannot affect orders in progress, invoiced on the basis of the rates in force at the time of validation of the order by the Customer.

Payment is due immediately upon ordering and is made by bank card (Mastercard or Visa for cards issued by banks domiciled outside France). Secure online payment is made by the payment provider Stripe. It is specified that the order will only be considered validated after receipt of full payment of the order amount. Jacques Monneraud reserves the right to suspend or cancel any order in the event of refusal of authorization for payment by credit card from officially accredited organizations or in the event of non-payment. The Products remain the property of Jacques Monneraud until full payment of the price.

Delivery of the Products is made to the address indicated by the Customer when ordering within the standard delivery times of the Colissimo postal service depending on the delivery destination. It is important to note that the order preparation time, which takes place within fifteen (15) working days following confirmation of the order, is not included in the standard delivery times of the Colissimo postal service announced above. If the Customer provides an incorrect address and the package is not delivered as a result, their order will not be refunded or replaced. As soon as the Customer takes physical possession of the Products, the risk of loss or damage to said Products rests with him. Consequently, it is the Customer’s responsibility to notify the carrier of any reservations about the delivered Product. When the Customer chooses the “Retrait à l’atelier” option, Jacques Monneraud will contact the Customer to arrange an appointment.

In accordance with article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the Products to exercise his right of withdrawal without having to justify reasons or pay penalties, with the exception of return costs which remain the responsibility of the Customer. The Customer may exercise his right of withdrawal by sending a written request by email to the following address: hello@jacquesmonneraud.com The return of the Product is made in its original packaging, intact, in perfect resalable condition and, if possible, accompanied by a copy of proof of purchase. Jacques Monneraud will reimburse the total amount of the order, with the exception of return costs, within thirty (30) days following receipt of the package.

Jacques Monneraud undertakes to respect the legal guarantees of conformity and hidden defects provided respectively by articles L.217-4 et seq. of the French Consumer Code and 1641 of the French Civil Code. The implementation of the guarantees must be the subject of a written request by email to the following address: hello@jacquesmonneraud.com. The complaint must be motivated and accompanied by the corresponding supporting documents. The Product is returned in its original packaging, intact, in perfect condition for resale and, if possible, accompanied by a copy of proof of purchase. Jacques Monneraud will reimburse the total amount of the order, with the exception of return costs which remain the responsibility of the Customer, within thirty (30) days following receipt of the package.

The Customer may submit any complaint by contacting Jacques Monneraud at the following address: hello@jacquesmonneraud.com. In accordance with the provisions of the French Consumer Code concerning “the mediation process for consumer disputes”, the Customer has the right to use the mediation service offered by the European online dispute resolution platform free of charge. This mediation system can be reached online via the following website: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=FR.

All elements appearing on the Website, whether visual or audio, as well as the Products sold on the Website are protected by copyright and other intellectual property rights. They are the exclusive property of Jacques Monneraud. No transfer of intellectual property rights is made through these Terms and Conditions. Any unauthorized reproduction, representation, adaptation or exploitation of all or part of these elements is strictly prohibited.

These Terms and Conditions are subject to French law. In the event of a dispute relating to the interpretation, execution or termination of these Terms and Conditions, the Customer will contact Jacques Monneraud at the following address: hello@jacquesmonneraud.com, in order to seek an amicable solution. In the absence of an amicable agreement, the dispute will be brought before the French courts.
